METROPOLITAN COUNCIL Mears Park Centre, 250 E. 5th Street, St. Paul, Minnesota 55101 612-291-6359 RESOLUTION NO. 95-3 RESOLUTION REQUIRING MODIFICATION OF A PROPOSED AMENDMENT TO TIIE CITY OF RAMSEY COMPREHENSIVE PLAN WHEREAS, .the city of Ramsey, by letter submitted October .21, 1993 transmitted a proposed 'amendment to its adopted comprehensive plan requesting to' add 1,455 gross acres to its MUSA, in accordance with the Metropolitan Land Planning Act and the Council Guidelines for Reviewing Local Comprehensive Plan Amendments; and WHEREAS, at its meeting on January 12, 1995 the Metropolitan Council reviewed the city of Ramsey's plan amendment and adopted a plan review report, Referral Report 13834- 7, in accordance with the Metropolitan Land Planning Act and the Council Guidelines for Reviewing Local Comprehensive Plan Amendments; and WHEREAS, the proposed amendment has been reviewed for impacts on metropolitan systems, apparent consistency with other adopted Metropolitan Development Guide chapters and compatibility with plans of adjacent local units ofgovemment; and WHEREAS, the Council has concluded that the amendment as proposed constitutes a substantial impact on or substantial departure from the Council's Wastewater Treatment and Handlin~ Policv Plan. and that a plan modification is required prior to Council approval. NOW, THEREFORE, BE IT RESOLVED, That the Metropolitan Council: 1. Adopt the staff report and findings as part of these recommendations; 2 Inform the city of Ramsey that pursuant to the Metropolitan Land Planning Act (Minnesota Statutes See. 473.175, Subd. 1), before it can put the plan amendment into effect it must agree to, within nine months of final Council action on this document, incorporate post-installation inspection and maintenance within the city's on-site ordinance and sewage system management program. The requirement would entail biennial inspections, at a minimum, of each on-site system in the city to verify its continued proper operation and need for solids removaL Inspections must be carried out by an inspector certified by the MPCA, and licensed by the city and/or county. The city's program is expected to include the keeping of records, licensing, correction of existing system problems and training of personnel as outlined in the Council's Policy Plan. . 3. Recommend that the city update its Tier II Comprehensive Sewer Plan to include the revisions requested in the former Metropolitan Waste Control Commission's March 23, 1994 letter reviewing this amendment, and submit the revised document to the Council for review and comment.
