VIOLATIONS AND PENALTY <br />The platting, replatting, subdividing, conveyance of land or <br />construction of a sewage disposal system not in accordance with <br />the requirements of this section may be enforced by mandamus, <br />injunction or any other appropriate remedy in any court of <br />competent jurisdiction. <br />FLOOD PLAIN REQUIREMENTS <br />No land shall be subdivided which is held unsuitable by the City <br />Council for reason of flooding inadequate drainage, water supply <br />or sewage treatment facilities. All lots within the flood plain <br />districts shall contain a building site at or above the Regulator <br />Flood Protection Elevation and shall be located outside the <br />floodway district. All subdivisions shall have water and sewage <br />disposal facilities that comply with the provisions of the City <br />Code and have road access both to the subdivision and to the <br />individual building sites no lower than two feet below the <br />Regulatory Flood Protection Elevation. <br />Prior to subdividing in the General Flood Plain District, the <br />subdivider shall provide the information required in Section <br />170.069.41 of City Ordinance No. 79 -13. The City Council shall <br />evaluate the subdivision in accordance with procedures <br />established in Section 170.069.41 and of City Ordinance No. 79 -13 <br />and standards contained in Section 170.069.43 of City Ordinance <br />79-13. <br />
