As you are aware, MC will not
approve MUSA expansions unless the city complies or agrees to
comply with MC policies within a certain time period.

As a condition of implementing "4 in 40" zoning, all plats and
PUD's which were in the process and received approval of the
preliminary plat or PUD by January 1, 1990 were allowed to continue
under the then existing zoning (2.5 acre or PUD with 2.5 acre
density) .

We are enclosing herein the following information as evidence that
the City is in compliance with MC's "4 in 40" rural use policies:

1. July 20, 1989 letter from MC approving the MUSA expansion.

2. List and map of subdivisions which were in process and
received preliminary approvals prior to January 1, 1990.

3. Resolutions:

89-06-129 -

Revisions to on-site systems. Ordinance and
soils ordinance adopted 6/13/89.
Sanitary sewer ordinance amendments.

89-06-130
