AN ORDINANCE AMENDING SECTION 210.2 of the City Code. SUMMARY An ordinance amending the Water and. Sewer Utilities chapter defining when sanitary sewer service is determined to be available. The City of Ramsey ordains: SECTION 1. AMENDMENT Section 210.2 of the Ramsey City Code pertaining to Applications for Service, Subdivision 3 is repealed and is amended to read as follows; The owner of all dwellings, buildings, other structures or properties where cesspools or septic tanks have been in existence prior to construction of a sanitary sewer shall connect with the public sanitary sewer when such cesspools and septic tanks are in need of repair, reconstruction or pumping, or within two (2) years of the date that municipal sanitary sewer service is available to the premises, whichever is first to occur. Municipal sanitary sewer service shall be determined to be available to the premises when trunk or lateral sewer occupies the right -of -way or easement adjacent to or on the property. In the event that the City Council finds that hookup to municipal sewer is not feasible due to distance, topography, physical barrier or pending land use change; sewer connection sh not be required until such condition changes thereby allowing for feasible connection. SECTION 2. EFFECTIVE DATE This Ordinance becomes effective upon its passage and thirty (30) days after is publication according to law, subject to City Charter Provision, Section 5.04. PASSED, by the City Council of the City of Ramsey, Minnesota on the 2 th day of September , 1989.
