• • SECTION 4. PROHIBITION During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Zoning and Subdivision of Land," no subdivision, rezoning, site plan approvals, conditional use permits or variances of any kind shall be permitted and no applications for said subdivision, rezoning, site plan approval, conditional use permit or variance shall be accepted on the parcels identified as follows: 35-32-25-24-0004 35-32-25-31-0005 35-32-25-31-0010 35-32-25-31-0011 35-32-25-31-0012 35-32-25-31-0025 35-32-25-31-0026 35-32-25-31-0027 35-32-25-31-0028 SECTION 5. UNDUE HARDSHIP EXCEPTIONS The City Council may grant an exception to the provisions of this Ordinance when, in its opinion, undue hardship may result form strict compliance. In granting an exception, the City Council shall prescribe any conditions that it deems necessary to or desirable for the protection of the public interest. NO exception shall be granted unless the City Council finds: 1. That there are special circumstances or conditions affecting said property such that the strict application of the provisions of this Moratorium Ordinance would deprive the petitioner of the reasonable use of petitioner's land. 2. That the exception is necessary for the preservation and enjoyment of a substantial property right of the petitioner. 3. That the granting of the exception will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated. 4. That the proposed exception will be harmonious with and in accordance with the specific objectives of the City's existing Comprehensive Plan and will not adversely affect the planning process for adoption of amendments to the Comprehensive Plan above described. 5. That the proposed use/subdivision will be consistent with the intent and purpose of this Ordinance. SECTION 6. TERM The term of this Ordinance shall be for a period of six months commencing with its effective date.
