•
of which could be utilized toward this process. This grant could be matched with unallocated
block grant funds and/or planning funds within the existing budget ($25,000 is within the budget
for storm water planning and $2,500 is in the Council budget for team building). Given this, it
appears that there is funding capacity to provide for at least a large portion, if not all of the
project.
At the last meeting, staff provided a spreadsheet detailing the premise that our zoning activity
post comprehensive plan updates was minimal. It now appears that there were significant errors
in that document. Attorney Goodrich has determined that, in addition to rural and commercial
platting, there have been fifty-seven urban residential plats approved since 1980. Of those, forty-
two have been rezoned prior to completion of the final plat (from either a rural or a business
designation). Four more have been rezoned after final plat approval and eleven have not been
rezoned. Of the eleven, seven resulted from the 1989 expansion of the Metropolitan Urban
Service District (MUSA) and four more resulted from the 1995 MUSA expansion. Of those
rezoned after final plat approval, all were within the original MUSA.
As a result of the zoning issue confusion, at least a few improvements in procedure need to be
made. The first, already in process, is to amend our land use application form to require not only
a statement as to the zoning of a particular parcel but to also include the ordinance number that
provides for that zoning. The second is to add a rezoning component to the Comprehensive Plan
process so that approval of a Comprehensive Plan includes, as a corollary action, adoption of an
ordinance and zoning map effecting the contemplated changes (contingent upon Metropolitan
Council approval). Third, we need to provide for adoption by Council of a new zoning map at
this time and would ask that Council direct that this process be initiated. Finally, we would ask
the Planning Commission Task Force, currently working on Chapter Nine of the City Code, to
also review the issue of rural versus urban designations and performance issues related to both.
Council Action:
Motion to adopt Ordinance #97-XX placing a moratorium against residential property
development.
Roll Call Vote
- and -
Motion to direct that staff provide a recommendation for a comprehensive planning process,
funding, and consulting assistance by the April 22, 1997 Council meeting or earlier if possible.
- and -
Motion to direct that staff provide direction as necessary regarding zoning activities pursuant to
the above discussion.
- and -
