• <br />the adoption of policies, procedures and ordinance amendments relating to the Comprehensive <br />Plan amendments referenced above. <br />SECTION 4. PROHIBITION. <br />During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Zoning <br />and Subdivision of Land," no subdivision or platting of any land within the City shall be <br />permitted and no applications for said subdivision or platting shall be accepted, except for those <br />lands identified in Sections 5 and 6 below. <br />SECTION 5. EXCLUSIONS. <br />The following lands within the City are excluded from this Interim Ordinance: <br />1. All land currently located within the City's following listed zoning districts: <br />B-1 Business District; <br />B-2 Business District; <br />B-3 Highway Business District; <br />B-W Business/Warehouse District; <br />RB Rural Business District; <br />I Industrial District; and <br />R-1 Rural Industrial District. <br />2. That land included within the proposed ALPINE ESTATES subdivision as legally described <br />and shown on the sketch plan for said proposed plat previously filed with the City. <br />3. That land included within the proposed SUNFISH POND subdivision as legally described <br />and shown on the preliminary plat for said proposed plat previously filed with the City. <br />4. Any lands for which the City Council has approved, prior to the effective date of this <br />Ordinance, a preliminary or final plat. <br />SECTION 6. UNDUE HARDSHIP EXCEPTIONS. <br />The City Council may grant an exception to the provisions of this Ordinance when, in its <br />opinion, undue hardship may result from strict compliance. In granting an exception, the City <br />Council shall prescribe any conditions that it deems necessary, or desirable for, the protection of <br />the public interest. No exception shall be granted unless the City Council finds: <br />1. That there are special circumstances or conditions affecting said property such that the strict <br />application of the provisions of this Moratorium Ordinance would deprive the petitioner of <br />the reasonable use of petitioner's land. <br />2. That the exception is necessary for the preservation and enjoyment of a substantial property <br />right of the petitioner. <br />1 <br />
