• the adoption of policies, procedures and ordinance amendments relating to the Comprehensive Plan amendments referenced above. SECTION 4. PROHIBITION. During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Zoning and Subdivision of Land," no subdivision or platting of any land within the City shall be permitted and no applications for said subdivision or platting shall be accepted, except for those lands identified in Sections 5 and 6 below. SECTION 5. EXCLUSIONS. The following lands within the City are excluded from this Interim Ordinance: 1. All land currently located within the City's following listed zoning districts: B-1 Business District; B-2 Business District; B-3 Highway Business District; B-W Business/Warehouse District; RB Rural Business District; I Industrial District; and R-1 Rural Industrial District. 2. That land included within the proposed ALPINE ESTATES subdivision as legally described and shown on the sketch plan for said proposed plat previously filed with the City. 3. That land included within the proposed SUNFISH POND subdivision as legally described and shown on the preliminary plat for said proposed plat previously filed with the City. 4. Any lands for which the City Council has approved, prior to the effective date of this Ordinance, a preliminary or final plat. SECTION 6. UNDUE HARDSHIP EXCEPTIONS. The City Council may grant an exception to the provisions of this Ordinance when, in its opinion, undue hardship may result from strict compliance. In granting an exception, the City Council shall prescribe any conditions that it deems necessary, or desirable for, the protection of the public interest. No exception shall be granted unless the City Council finds: 1. That there are special circumstances or conditions affecting said property such that the strict application of the provisions of this Moratorium Ordinance would deprive the petitioner of the reasonable use of petitioner's land. 2. That the exception is necessary for the preservation and enjoyment of a substantial property right of the petitioner. 1
