a • <br />CASE # /L) <br />ADOPT ORDINANCE ESTABLISHING A SIX MONTH MORATORIUM ON THE <br />SUBDIVISION OF LAND WITHIN A PART OF THE CITY AND' REZONING <br />By: William K. Goodrich, City Attorney <br />Background: <br />On May 27, 1997, the City Council introduced an interim ordinance <br />placing a moratorium for six months on the subdivision and rezoning <br />of all land within the City, excepting only industrial/commercial <br />property located within the MUSA. This ordinance is now presented <br />for adoption and if adopted this evening it would be published on <br />June 13, 1997 and become effective July 13, 1997. <br />The first 30 day interim moratorium ordinance regarding subdividing <br />was adopted on April 8, 1997 and expires on June 11, 1997. That <br />ordinance provided an option for an extension by the Council, which <br />extension can be done by resolution. Such an extension is <br />necessary to fill the gap between June 11, 1997 (the expiration <br />date of the 30 day interim moratorium ordinance) and July 13, 1997 <br />(the effective date of the six month interim moratorium ordinance) . <br />The extension resolution may exclude any property the Council <br />determines appropriate. <br />It is staff's understanding that the Apple Ridge subdivision is to <br />be excluded so that it can be acted upon prior to July 13, 1997 and <br />therefore the extension resolution has been drafted accordingly. <br />Enclosures: <br />The following items are enclosed for your information: <br />a) Six month interim moratorium ordinance <br />b) Extension resolution <br />Recommendation: <br />City staff recommends adoption of the six month interim moratorium <br />ordinance and adoption of the extension resolution excluding <br />specifically the Apple Ridge subdivision. <br />Council Action: <br />Motion to adopt Ordinance #97 which is an interim <br />ordinance establishing a moratorium on the rezoning and subdividing <br />of land for a term of six months within a part of the City of <br />Ramsey, Anoka County, Minnesota <br />and <br />
