• • <br />SECTION 4. UNDUE HARDSHIP EXCEPTIONS <br />The City Council may grant an exception to the provisions of this Ordinance when, in its <br />opinion, undue hardship may result form strict compliance. In granting an exception, the City <br />Council shall prescribe any conditions that it deems necessary to or desirable for the protection <br />of the public interest. NO exception shall be granted unless the City Council fords: <br />1. That there are special circumstances or conditions affecting said property such <br />that the strict application of the provisions of this Moratorium Ordinance would <br />deprive the petitioner of the reasonable use of petitioner's land. <br />2. That the exception is necessary for the preservation and enjoyment of a substantial <br />property right of the petitioner. <br />3. That the granting of the exception will not be detrimental to the public welfare or <br />injurious to other property in the area in which the property is situated. <br />4. That the proposed exception will be harmonious with and in accordance with the <br />specific objectives of the City's existing Comprehensive Plan and will not <br />adversely affect the planning process for adoption of amendments to the <br />Comprehensive Plan above described. <br />5. That the proposed use/subdivision will be consistent with the intent and purpose <br />of this Ordinance. <br />SECTION 5. TERM <br />The term of this Ordinance shall be for a period of six months commencing with its effective <br />date. The term may be extended after approval by the City Council for an additional period not <br />exceeding 24 months, as provided for in Minnesota Statutes, Section 462.355, Subd. 4. <br />SECTION 6. PENALTIES <br />Any person, firm, entity or corporation that undertakes any development activity in violation of <br />the provisions of this Ordinance shall be guilty of a misdemeanor and shall be subject to any <br />additional legal or equitable remedies available to the City. <br />SECTION 7. EFFECTIVE DATE. <br />This Ordinance shall take effect upon adoption and thirty (30) days after publication according to <br />law, subject to Charter Provision, Section 5.04. <br />
