Some residents of the <br />city contend that the comprehensive plan amendment was not completed in accordance with state <br />law and has never become effective. You have asked our firm to review the documentary record <br />regarding the comprehensive plan amendment and render an opinion regarding the matter. <br />Following a review of the material you submitted and after discussion with the Metropolitan <br />Council staff, it is our opinion that the amendment became effective in 1995 and modified the <br />city's comprehensive plan. <br /> <br />According to the documents you have submitted, on October 20, 1993, the city staff forwarded <br />to the Metropolitan Council a proposed major amendment to the city's comprehensive plan. The <br />principal goal of the amendment was to increase the portion of the city within the municipal <br />urban services area. The submission was made prior to formal review of the matter by the <br />Ftamsey planning commission or city council. The reason for the early submission was the staff's <br />attempt to log an amendment with the ~etropolitan Council prior to adoption of anticipated <br />changes in its procedures for review of comprehensive plans. <br /> <br />On November 4, 1993, the planning commission held a public hearing to consider the <br />comprehensive plan amendment. The public hearing was held following notice published on <br />October 22, 1993 and October 29, 1993 in the official newspaper. After the public hearing on <br />that evening, the planning commission voted unanimously to recommend that the city council <br />approve the comprehensive plan amendment. <br /> <br />At its meeting on November 9, 1993, the city council considered the planning commission's <br />recommendation regarding the comprehensive plan amendment.
