<br />CASE # <br /> <br />PUBLIC HEARING <br />REQUEST FOR COMPREHENSIVE PLAN AMENDMENT; <br />CASE OF SCOTT HAGEN <br />By: Amy Geisler, Associate Planner <br /> <br />Background: <br /> <br />The 2001 Comprehensive Plan shows the parcel south of Highway 10, immediately west of <br />Llama Street as Medium Density Residential. A commercial use, Hi-Ten Sports, has been <br />operating on the parcel for many years. In the process of selling the property, the owner and staff <br />became aware of the parcel's Medium Density Residential land use designation. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Exhibit showing property subject to Comprehensive Plan Amendment <br />c) Proposed Resolution approving the request and authorizing submittal to Metropolitan <br />Council <br /> <br />Notification: <br /> <br />State law requires that property owners within 350 feet of the subject property be notified of the <br />public hearing. <br /> <br />Observations: <br /> <br />Upon questioning from the property owner, staff reviewed the parcel's land use designation <br />through documents generated during the Comprehensive Planning process. The parcel was <br />shown with a commercial land use in earlier drafts of the Comprehensive Plan. Staff was unable <br />to determine the rationale for changing the parcel's designation to Residential in . the ..adopted <br />Comprehensive Plan. Staff feels that the existing commercial use of the property is more <br />compatible with the other commercial uses to the east in Alpaca Estates, rather than as a <br />Medium-Density Residential use. <br /> <br />Even though it appears that the parcel's current designation is a technical error, it was shown as <br />Medium Density Residential in the 2001 Comprehensive Plan adopted by. the City Council. <br />Because of this, the applicant must apply for a Comprehensive Plan Amendment and Rezoning. <br />
