<br />CASE # <br /> <br />PUBLIC HEARING <br />REQUEST FOR COMPREHENSIVE PLAN AMENDMENT; <br />CASE OF ARTHUR AND ELIZABETH RAUDIO <br />By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />The Future Land Use Map of the 2001 Comprehensive Plan identifies Outlot E, River's Bend 3rd <br />Addition as Medium Density Residential. Since at least the mid -1980's, this vacant parcel was <br />zoned commercial. Upon a recent inquiry from the owners, Arthur and Elizabeth Raudio, <br />regarding a potential buyer and development of the parcel with a commercial use, it was <br />discovered that the parcel had been rezoned to medium density residential. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Proposed Resolution approving the request and authorizing submittal to Metropolitan <br />Council <br /> <br />Notification: <br /> <br />State law requires that property owners within 350 feet of the subject property be notified of the <br />public hearing. <br /> <br />Observations: <br /> <br />At Mr. Raudio's request, Staff did some research as to when the property was actually rezoned <br />from commercial to medium density residential. The last time there was official action on the <br />property was in 1993 when a portion of River's Bend 3rd Addition was rezoned from commercial <br />to single family residential. At that time, the zoning on Outlot E was not changed and remained <br />as commercial. Staff found a zoning map from 1998 in which the property was shown as <br />medium density residential. It is staff s belief that somewhere along the line an error occurred <br />and the subject parcel was colored as medium density residential on the City's zoning map. It <br />would have been difficult to recognize the error as the two vacant parcels north of Mr. Raudio's <br />parcel are also zoned medium density residential. <br /> <br />Even though it appears that the parcel's current designation started as a technical error on the <br />zoning map, it was shown as Medium Density Residential in the 2001 Comprehensive Plan <br />adopted by the City Council. Because ofthis, the applicant must apply for a Comprehensive Plan <br />Amendment and Rezoning. <br />
