Absent: Councilmembers Olson and Strommen. <br /> <br />Councilmember Elvig stated this is a great example of why the City changed the ordinance to <br />allow for the incubation of small businesses in homes under regulations and watched carefully. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to adopt Resolution #06- <br />08-266 approving Scott Johnson's request for a home occupation permit based on the Findings of <br />Fact. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Jeffrey, Cook, and <br />Pearson. Voting No: None. Absent: Councilmembers Olson and Strommen. <br /> <br />Mayor Gamec stated the Council appreciates Mr. Johnson going through the correct process in <br />obtaining the home occupation permit. <br /> <br />Case #2: <br /> <br />Adopt Findings of Fact Related to a Request for Exception from <br />Development Moratorium; Case of Ron Tallman <br /> <br />Community Development Director Trudgeon reviewed that the R-l Residential Rural <br />Developing District is currently under a moratorium for the subdivision of land. Ron Tallman <br />has requested an exception to the moratorium in order to proceed with his proposed subdivision, <br />Wild Oaks of Ramsey. The City Council considered Mr. Tallman's exception request at the <br />regular August 8, 2006 meeting. Staffwas directed to draft Findings of Fact to deny the request, <br />based on the criteria contained in the moratorium ordinance; Draft findings are included for <br />Council consideration. <br /> <br />Mayor Gamec asked if this case can be tabled until there is a full Council present. <br /> <br />Community Development Director Trudgeon responded in the affirmative. <br /> <br />Councilmember Elvig stated he has family with property in Oak Grove that just received a bill <br />adding 50% of their fees for a cluster and communal septic system. This was due to additional <br />criteria from the DNR requiring the nitrogen level in anything discharged from the communal <br />system to be at the same level as drinking water. These additional criteria resulted in $700,000 <br />in additional infrastructure that the association will have to pay for, which resulted in an <br />additional 50% to the homeowners' fees. His concern is with additional information or criteria <br />coming forward, and a small association being stuck with a huge bill, while the City does not <br />have the answers on how to take care of these types of situations. This is a much bigger situation <br />than just access as to the reason for the moratorium. <br /> <br />Mayor Gamec questioned if the development Councilmember Elvig referred was required to <br />meet the criteria before the development went in. <br /> <br />Councilmember Elvig replied additional criteria were just put in place by the MPCA; this could <br />make some of these cluster development projects no longer affordable. <br /> <br />City Council / August 22, 2006 <br />Page 5 of 18 <br />
