Absent: Councilmembers Olson and Strommen. <br />COUNCIL BUSINESS <br />Case #1: Request for a Home Occupation Permit; Case of Scott Johnson <br />Community Development Director Trudgeon explained the City has received an application <br />from Scott Johnson for a home occupation permit to operate a family -run wholesale bakery in <br />the basement of his home located at 5560 - 144 Avenue NW. The business, Jenny Ann Cakes, <br />consists of entirely baking cakes and delivering them to clientele. There is no frying or grease <br />used in the baking process. Mr. Johnson and his wife deliver the cakes, by personal vehicle, to <br />clients' homes and/or to multiple business locations in the metro area; there are no sales <br />transactions that occur on site and thus, no customers coming to or from the home. Mr. <br />Trudgeon advised City Code restricts home occupations to 20% of the gross floor area of the <br />home. The proposed bakery operation would be conducted in a portion of the basement that <br />constitutes roughly 10% of the gross floor area of the dwelling. The only employees involved <br />with this business are Mr. Johnson and his wife, Nhu Tran, both of whom reside on the premises. <br />Since there are no on -site sales involved with this business, there is no need for additional off- <br />street parking space. There will be few, if any deliveries to the home, as Mr. Johnson and his <br />wife pick up all ingredients themselves. All necessary equipment and appliances are typical <br />residential units with standard voltages. There will be no exterior evidence of the business; no <br />signs will be displayed and there will be no outside storage of equipment or merchandise. Mr. <br />Trudgeon advised the Planning Commission and staff recommend approval of the home <br />occupation permit request. <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to adopt Resolution #06- <br />08 -265 adopting Findings of Fact #0775 relating to Scott Johnson's request for a home <br />occupation permit. <br />City Council / August 22, 2006 <br />Page 4of18 <br />
