In addition, <br />the septic system was designed by the top engineer in the state who has done 35 cluster systems <br />around the state. A 30 page booklet has been prepared, with $17,000 spent on soil testing. The <br />system is ready to go. Councilmember Cook explained he tabled this application in order for it <br />to be acted on with a full Council. The application would likely have been approved tonight, but <br />when the full Council debates it would likely be a negative vote on the site plan, and it makes no <br />sense to put the applicants in that situation. When this vote goes forward he wants it to be a <br />legitimate vote for the applicant. <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Elvig, Jeffrey, and <br />Pearson. Absent: Councilmembers Olson and Strommen <br />Case #3: Request for a Conditional- Use Permit for Klein Bank to Operate a Drive- <br />Thru in the TC -2 Zoning District; Case of Shingobee Builders, Inc. <br />Community Development Director Trudgeon explained Case No. 3 and 4 are related and will be <br />discussed together. Mr. Trudgeon stated Shingobee Builders, Inc. has submitted a site plan for <br />the development of Klein Bank located generally on the corner of Armstrong Boulevard and <br />West Ramsey Parkway. The TC -2 District requires a conditional use permit (CUP) for uses with <br />a drive -thru. The applicant has submitted an application for a CUP in order to operate a drive- <br />thru banking facility. The drive -thru is proposed to be located on the north side of the proposed <br />Klein Bank building, with a drive aisle along the west side. It is proposed to be four stalls wide, <br />resulting in a 70 foot building setback from West Ramsey Parkway. The vehicles would exit the <br />drive -thru by circulating around the building and exiting through the same way they entered. Mr. <br />Trudgeon stated the Planning Commission met on August 3, 2006, and recommended that the <br />City Council approve the CUP for the drive -thru for Klein Bank. The Commission thought the <br />general use was compatible in the area, but expressed concern about the northern location of the - <br />drive -thru and the need for a drive aisle. After a long discussion about various other <br />possibilities, it was determined that the north side was the best location to meet the business' <br />needs for adjacent parking and ease of traffic circulation. Mr. Trudgeon stated staff also had <br />concerns with the proposed location of the drive -thru on the north side of the property; however, <br />staff understands the need to accommodate various business requirements for drive- thrus, and <br />parking. <br />Community Development Director Trudgeon advised the Planning Commission and staff <br />recommend approval of the CUP, contingent upon the following conditions: <br />1) The installation of a berm on both the west and the north boulevards between the parking <br />areas /drive aisles and the sidewalk to reduce the visual impact of the parking lot and <br />drive -thru in these areas <br />2) The installation of pedestrian- oriented fencing, as discussed, to frame the sidewalk area <br />3) The installation of tall shrubs and small trees to provide additional screening <br />4) Compliance with City Staff Review Letter dated July 28, 2006 <br />Community Development Director Trudgeon stated Shingobee Builders, Inc. has submitted a site <br />plan for the construction of a 15,500 square foot two -story banking facility with a drive -thru <br />City Council / August 22, 2006 <br />Page 9of18 <br />
