Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> RESOLUTION #94-05-103 <br /> RESOLUTION ADOPTING FINDINGS OF FACT #362 RELATING TO A REQUEST <br /> FOR A CONDITIONAL USE PERMIT FOR A HOME OCCUPATION ON THE <br /> PROPERTY GENERALLY KNOWN AS 14794 KRYPTON COURT N.W. <br /> WHEREAS,Diane Dempsey, hereinafter referred to as "Applicant", has properly applied <br /> for a Conditional Use Permit for a Home Occupation to conduct doll-making classes on the <br /> property generally known as 14794 Krypton Court N.W. and legally described as follows: <br /> Lot 4, Block 3, WOOD POND HILLS 3RD ADDITION, Anoka County, State of <br /> Minnesota. <br /> (the "Subject Property") <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1) That the Applicant appeared before the Planning and Zoning Commission for a public <br /> hearing pursuant to Section 9.03.04 (Conditional Use Permit) and Section 9.11.04 (Home <br /> Occupations) of the Ramsey? City Code on May 2, 1994, and that said public hearing was <br /> part of these findings by reference. <br /> 2) That the Applicant's dwelling is the initial home to be developed on Krypton Court N.W. <br /> and therefore all affected property owners will not have had the opportunity to comment <br /> on the request for a conditional use permit for a home occupation because at the time of <br /> the public hearing mailing, ownership of all surrounding parcels is retained by the <br /> developer of Wood Pond Hills. <br /> 3) That the subject property is zoned R-1 Urban Residential and is approximately 13,000. <br /> 4) The commercial activities are not a permitted use in the R-1 Urban Residential zoning. <br /> 5) That the subject property is surrounded by R-1 Urban Residential zoning. <br /> 6) That the Applicant has provided documentation to support that the home occupation will <br /> be conducted within the private dwelling on the property and that the area set aside for the <br /> home occupation does not exceed 20% of the total floor area of the primate dwelling. <br /> 7) That the Applicant will reside at the location of the proposed home occupation. <br /> 8) That the Applicant has stated that the home occupation will not include any employment <br /> of persons not residing in the private dwelling in the performance of the home occupation. <br />
