Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #06-10-xxx A RESOLUTION ADOPTING FINDINGS OF FACT #Xxx RELATING TO A REQUEST FROM PROFESSIONAL PROPERTIES, LLC TO ALLOW FOR A DA YCARE FACILITY ON THE PROPERTY LOCATED AT 6575 141sT AVE FOR AN INTERIM PERIOD OF TIME. Professional Properties, LLC, hereinafter referred to as "Applicant", properly applied to the City of Ramsey (the "City") for an Interim Use Permit to daycare facility on the ground floor of the site of their current facility for an interim period of time on the property generally known as 6575 141st Avenue and legally described as follows: Unplatted Ramsey Township north 200 feet of south 233 feet of west 200 feet of the east 1146 feet oithe south half of the Southeast Quarter of Section 27, Township 32, and Range 25, Anoka County, Minnesota (the "S ubject Property") NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on October 5, 2006 and that Jhe public hearing was properly advertised and that the minutes of said public hearing -are -_ hereby incorporated by reference. 2) That the Subject Property is approximately .92 acres in size (40,000 square feet) and is zoned E-1 Employment. 3) That Section 9.03.06(1) (Interim Use Permits) of the Ramsey City Code allows for interim uses to allow a use for a limited period of time that reasonably utilizes the property where it is not reasonable to utilize it in the manner provided by the comprehensive guide and to allow a use that is presently acceptable but that, with anticipated development will not be acceptable in the future. 4) That on September 7, 2006, the Applicant submitted an application requesting an Interim Use Permit to operate a daycare facility on the Subject Property. 5) That on October 5, 2006, the Ramsey Planning Commission held a public hearing to consider the Applicant's request and recommended approval to the City Council subject to certain conditions. 6) That the proposed daycare facility has stated the intent conform to the State Fire, MN State Building Codes, and the City's grading, drainage, erosion control, and utility standards. 7) The proposed daycare has stated the content conform to the State Child Care standards 24
