<br />CASE # { <br /> <br />PUBLIC HEAR1NG <br />REQUEST FOR AN AMENDED CONDITIONAL USE PERMIT FOR - <br />NORTH~RN COUNTIES SECRETARIAL; CASE OF CAROL OWENS <br />By: Asst. Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Northern Counties Secretarial Services is located at 6139 lsih Lane N.W. The property is <br />zoned R-1 Residential. Lord of Life church used to occupy the building on the property before <br />they built their new church south of the Municipal Center. In 1991, the City Council issued a <br />Conditional Use Permit to Carol Owens to occupy the vacant building with her secretarial-- <br />service, other professional offices, and daycare services. The Conditional Use Permit allowed <br />Ms. Owens the opportunity to increase the building area on the site up to 22,000 square feet <br />without the need for additional amendments to the Conditional Use Permit. This did not exempt <br />her from any other applicable zoning or building codes. In addition, the Conditional Use Permit <br />established a 120 foot structure setback from the north and east property lines. The intent of this <br />setback was to _ provide a buffer between existing residents and any future expansions of her <br />commercial operations. To date, the building has not been expanded and no daycare service has <br />been established at the site. <br /> <br />Notification: <br /> <br />In accordance with City Code, the City attemped to notify owners of property within 350 feet oC <br />the Subject Property of the public hearing and request for amendment of Conditional Use Permit. <br /> <br />Observations: <br /> <br />Louis and Jacqueline Abendroth reside on the adjacent lot to the north. Their driveway <br />extension encroaches on Ms. Owens property by approximately 5 feet. The Abendroths have <br />been leasing a 10 foot strip from Ms. Owens along the common property line since 1993. The <br />Abendroths would like to own that 10 feet and make their driveway lawful conforming. Ms. <br />Owens is willing to deed the property to Abendroths but is requesting a 10 foot reduction in the <br />structure setback established in her Conditional Use Permit in lieu of the land conveyance. <br /> <br />The following items are enclosed for your information: <br /> <br />a.
