6. 9. <br /> CC Regular Session <br /> Meeting Date: 02/25/2025 <br /> Primary Strategic Plan Initiative: Not Applicable <br /> Title <br /> Adopt Resolution#25-040 Approving Final Payment to Northwest Asphalt, Inc. for Improvement Project#24-111 <br /> MSA Alpine Drive Reconstruction. <br /> Purpose/Background: <br /> Resolution and Pay Request attached. <br /> Time Frame/Observations/Alternatives: <br /> Issuing final payment will be contingent on receipt of the following items from Northwest Asphalt, Inc.: <br /> 1. IC-134 (Contractor's Withholding Affidavit showing compliance with the provisions of Minnesota Statute <br /> 290.92 requiring withholding state income tax). <br /> 2. Waiver of Mechanic's Lien Rights (Affidavits that all claims against Northwest Asphalt, Inc.by reasons of the <br /> contract have been fully paid or satisfactorily secured). <br /> 3. Consent of Surety to Final Payment(Certification from the contractor's surety). <br /> Following receipt of these items, final payment will be issued. <br /> Final project costs exceeded the awarded project cost by approximately 6-percent due primarily to a need to <br /> replace more concrete curb and gutter than was identified in the plans, and more than estimated tonnage for the <br /> bituminous wear course. Staff completes field reviews during the design and plan preparation process in an <br /> attempt to accurately identify these pay items within the plans,but sometimes additional damage occurs to <br /> infrastructure between the time plans are prepared and construction begins. Staff will continue working to better <br /> define such quantity estimates during the design process to help minimize project cose over-runs on future <br /> proj ects. <br /> Recommendation: <br /> The Senior Engineering Technician has inspected the completed work and recommends final payment to <br /> Northwest Asphalt, Inc. for improvement project#24-11, MSA Alpine Drive Reconstruction in the amount of <br /> $921866.93. <br /> OutcomeAction: <br /> Motion to adopt Resolution#25-040 approving final payment to Northwest Asphalt, Inc. for improvement project <br /> #24-11 MSA Alpine Drive Reconstruction in the amount of$92,866.93. <br /> Attachments <br /> Pay Resolution#25-040 <br /> Pay Request <br /> Form Review <br /> Inbox Reviewed By Date <br /> Bruce Westby Bruce Westby 02/20/2025 12:43 PM <br />
