-128 <br />That the Applicant desires to grant the Abendroths fee title to that 10 feet along the north <br />property line of the Subject Property via an administrative subdivision. <br />That the Applicant is requesting that the 100 foot buffer area on common property line with <br />the Abendroth parcel, as established in Exhibit A to the Conditional Use Permit issued in <br />1991, be reduced to 80 feet, and that a 20 foot structure setback will be maintained from <br />the 80 foot buffer line. <br />10. That the reduction in the structure setback on the Subject Property will allow the <br />administrative subdivision to proceed and eliminate a nonconforming encroachment on the <br />Subject Property. <br />11. That the proposed reduction in structure setback will not be unduly dangerous or <br />detrimental to persons residing or working in the vicinity of the use, or to the public <br />welfare. <br />12. That the reduction in structure setback will not substantially adversely impair the use, <br />enjoyment or market value of any of the surrounding properties. <br />13. That the proposed reduction in structure setback will be maintained so as to be harmonious <br />and appropriate in appearance with the existing or intended character of the general vicinity <br />and will not change the essential character of the area <br />14. That the proposed reduction in structure setback will not be hazardous to existing or future <br />neighboring uses. <br />15. That the proposed reduction in structure setback will not be disturbing to existing or future <br />neighboring uses. <br />16. That the proposed reduction in structure setback will not impact essential public facilities <br />and services, such as highways, streets, police and fire protection. <br />17. That the proposed reduction in structure setback will not create excessive additional <br />requirements at public cost for public facilities and services and will not be detrimental to <br />the economic welfare of the community. <br />18. That the . proposed use will not involve uses, activities and equipment that will be <br />detrimental to any persons, property, or the general welfare by reason of excessive <br />production of traffic, noise, smoke, fumes, glare or odors. <br />The motion for the adoption of the foregoing findings of fact was duly seconded by <br />Councilmember , and upon vote being taken thereon, the following voted in <br />favor thereof: <br />RESOLUTION #06 -10 - <br />Page 2 of 3 <br />
