Background: <br />CONSIDER AGENCY AGREEMENT NO 84229 WITH MNDOT <br />FOR TRANSPORTATION PROJECTS INVOLVING <br />THE DELEGATED CONTRACT PROCESS (DCP) <br />By Steven Jankowski, City Engineer <br />The delegated contract process allows municipalities to undertake transportation projects <br />which utilize Federal Highway Administration (FHWA) funds. The FHWA passes these <br />funds to municipalities through the Minnesota Department of Transportation which has <br />the responsibility to ensure that all federal requirements are being met in the use of the <br />designated funds. The attached agreement is not specific to any single project and is <br />required for any municipality that will be undertaking any federally funded project. The <br />agreement will also apply to additional federally funded projects that the city may <br />undertake in the future. The city anticipates projects that will utilize federal funds such <br />as the expansion of the municipal parking ramp and bus service to the Town Center. <br />Separate agreements will be necessary for these future projects in addition to this <br />agreement. <br />The contents of this agreement include a listing of the staffing, bid letting and award <br />procedures; contract administration; and audit and legal assurances of compliance with <br />federal regulations. The City Attorney has been sent a copy of this agreement for review. <br />Recommendation: <br />Staff recommends approval of entering into Agreement No. 84229 with the Minnesota <br />Department of Transportation. <br />Action: <br />Motion to adopt Resolution 06- 10 -XXX authorizing the Mayor and the City <br />Administrator to enter into Agreement No. 84229 with the Minnesota Department of <br />Transportation. <br />Reviewed by: <br />City Engineer <br />Public Works Director/Principal Engineer <br />Fire Chief <br />City Attorney <br />CC: 10/10/06 <br />—149— <br />
