Chairperson Nixt replied he would need to review the minutes of the meeting. He suspects after <br />the Comprehensive Plan was adopted there were a number of individuals in the City who either <br />did not pay attention or realized the zoning assigned to their property in the Comprehensive Plan <br />process was not to their satisfaction. <br />Mr. Holesek stated their zoning was not in compliance with the Comprehensive Plan because the <br />City changed the Comprehensive Plan. They requested a minor amendment to change the <br />Comprehensive Plan to fit their zoning, and instead the City chose to do the opposite. He stated <br />the City should treat like property like. <br />Commissioner Brauer stated the situation was that a property had mistakenly been zoned as B -2, <br />and was changed back to residential. This particular piece of property being discussed tonight <br />was not changed from B -2 to residential, which was due to the proximity of the bowling alley. <br />He believes the Commission felt there was no way to put a single family residence next to a <br />bowling alley. <br />Mr. Holesek questioned what the Commission suggests as a buffer with this parcel. <br />Chairperson Nixt replied medium density residential has been identified as appropriate, which he <br />is not inclined to disagree with He requested staff to provide information on eligible B -2 uses. <br />Associate Planner Dalnes replied B -2 zoning could include office use and could also include auto <br />repair and gas stations. <br />Chairperson Nixt stated this situation deals with the landowner's right to use his property and the <br />surrounding landowners' objections to change the zoning given that the site is challenged for <br />commercial development. This is a challenged commercial site, and if it remains zoned as <br />commercial it will likely remain vacant, which he has a difficult time with.. The applicant has <br />worked with the City. Medium density is appropriate as a transition between commercial and <br />residential. He understands the concerns, but many of the issues tonight are related to traffic, <br />which will be an issue whether there is medium density, single family or commercial. The traffic <br />will be more of a concern if the use is commercial. The concern regarding the townhome units to <br />the west creating problems is a public safety issue that needs to be addressed in the City. <br />Mr. Holesek stated a use such as a gas station would require a special permit. He feels it is very <br />unfair treatment to treat one person one way and another person another way on the same type of <br />zoning. He does not know what he would want for transitioning, but he would not want a <br />multiplex next to him. He has learned that it does not make much difference what the landowner <br />thinks in this City, because the City does what it wants anyway. <br />Mr. Blakemore questioned how the residents of the area have been incorporated into working <br />with the City along with the owner of the property. <br />Chairperson Nixt replied there have been public hearings held regarding this development. <br />Planning Commission /September 7, 2006 <br />Page 7 of 20 <br />-19- <br />
