_22_ Motion carried. Voting Yes: Commissioners Levine, Brauer, Cleveland, Hunt, and Trites Rolle. Voting No Chairperson Nixt. Absent: Commissioner Van Scoy. Motion by Commissioner Levine, seconded by Commissioner Cleveland, to recommend that the City Council approve findings of fact to support denial of the rezoning of the property from B -2 Business to Planned Unit Development, with finding nos. 13 through 18 as follows: 13. That the proposed development, if revised as requested, will not be compatible with surrounding land uses. 14. That the proposed development will not exercise substantial detrimental influence on the market value of surrounding properties. 15. That the proposed development will preserve natural amenities such as wetlands, water features, woodlands, and steep slopes. 16. That the proposed development will protect and preserve scenic qualities to the greatest extent possible. 17. That the proposed development will not impose undue burden on public services and facilities, including fire and police protection, schools, streets, water systems, sanitary sewer systems and storm sewer systems. 18. That the proposed development is not designed in such a way as to form a desirable and unified environment within its own boundaries, and also will be detrimental to future land uses in the surrounding areas: Motion carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Cleveland, Brauer, Hunt, and Trites Rolle. Voting No None. Absent: Commissioner Van Scoy. Motion by Commissioner Levine, seconded by Commissioner Brauer, to recommend that the City Council deny the rezoning of the property from B -2 Business to Planned Unit Development based on findings of fact. Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Brauer, Cleveland, Hunt, and Trites Rolle. Voting No None. Absent: Commissioner Van Scoy. Chairperson Nixt requested the Commission to provide comments as to whether there would be any reason to deny the preliminary plat if Council were to determine to approve the rezoning. Consensus of the Commission was that there is no apparent reason to deny the preliminary plat if Council were to approve the rezoning. Commissioner Levine commented the applicant has come back with a much better plan than the first plan submitted. Motion by Chairperson Nixt, seconded by Commissioner Hunt, to recommend that the City Council approve the preliminary plat and preliminary site plan for Ebony Woods, contingent upon the City Staff Review Letter and the City Council granting the Comprehensive Plan Planning Commission /September 7, 2006 Page 10 of 20
