_22_ <br />Motion carried. Voting Yes: Commissioners Levine, Brauer, Cleveland, Hunt, and Trites Rolle. <br />Voting No Chairperson Nixt. Absent: Commissioner Van Scoy. <br />Motion by Commissioner Levine, seconded by Commissioner Cleveland, to recommend that the <br />City Council approve findings of fact to support denial of the rezoning of the property from B -2 <br />Business to Planned Unit Development, with finding nos. 13 through 18 as follows: <br />13. That the proposed development, if revised as requested, will not be compatible with <br />surrounding land uses. <br />14. That the proposed development will not exercise substantial detrimental influence on the <br />market value of surrounding properties. <br />15. That the proposed development will preserve natural amenities such as wetlands, water <br />features, woodlands, and steep slopes. <br />16. That the proposed development will protect and preserve scenic qualities to the greatest <br />extent possible. <br />17. That the proposed development will not impose undue burden on public services and <br />facilities, including fire and police protection, schools, streets, water systems, sanitary <br />sewer systems and storm sewer systems. <br />18. That the proposed development is not designed in such a way as to form a desirable and <br />unified environment within its own boundaries, and also will be detrimental to future land <br />uses in the surrounding areas: <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Cleveland, Brauer, <br />Hunt, and Trites Rolle. Voting No None. Absent: Commissioner Van Scoy. <br />Motion by Commissioner Levine, seconded by Commissioner Brauer, to recommend that the <br />City Council deny the rezoning of the property from B -2 Business to Planned Unit Development <br />based on findings of fact. <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Brauer, Cleveland, <br />Hunt, and Trites Rolle. Voting No None. Absent: Commissioner Van Scoy. <br />Chairperson Nixt requested the Commission to provide comments as to whether there would be <br />any reason to deny the preliminary plat if Council were to determine to approve the rezoning. <br />Consensus of the Commission was that there is no apparent reason to deny the preliminary plat if <br />Council were to approve the rezoning. <br />Commissioner Levine commented the applicant has come back with a much better plan than the <br />first plan submitted. <br />Motion by Chairperson Nixt, seconded by Commissioner Hunt, to recommend that the City <br />Council approve the preliminary plat and preliminary site plan for Ebony Woods, contingent <br />upon the City Staff Review Letter and the City Council granting the Comprehensive Plan <br />Planning Commission /September 7, 2006 <br />Page 10 of 20 <br />
