CC Regular Session 5. 12. <br />Meeting Date: 01/24/2023 <br />By: Todd Larson, Community Development <br />Information <br />Title <br />Adopt Resolution #23-011 Approving Final Plat for Gile Addition and an Assessment Agreement <br />Purpose/Background: <br />The preliminary plat of Gile Addition was approved by the City Council on December 13, 2022. The final plat is <br />consistent with the preliminary plat which splits off one single-family lot from a homestead parcel in the Apple <br />Ridge development. <br />The plat creates half of the right-of-way necessary for the future connection of Krypton St. NW between 157th <br />Street and 157th Lane NW. An applicant is responsible for constructing all necessary infrastructure in typical <br />subdivisions. Since not all of the right-of-way is available, an assessment agreement is proposed that would <br />require the property owner at the time of the street construction to contribute monetarily. The street will be <br />constructed when the property to the east at 15700 St. Francis Boulevard NW subdivides and dedicated the <br />remaining right-of-way. This agreement runs with the land. In the event that the current property owner sells her <br />property, the future buyer will be responsible for payment. <br />The City Attorney has reviewed the proposed assessment agreement and has approved it to form. <br />One of the conditions of the preliminary plat approval was that each of the neighbors who the two outlots were <br />proposed for must provide proof that they will accept them. This requirement was created so that the outlots <br />would not become tax -forfeited property someday. One of the neighbors has stated that she would accept the <br />outlot adjacent to her property. The other neighbor has declined this offer. Therefore, the plat was revised to <br />incorporate that parcel (formerly Outlot B) into the applicant's parcel (Lot 1). <br />Notification: <br />Public notification was provided at the preliminary plat phase of the project. No public notification is required for <br />a final plat. <br />Observations/Alternatives: <br />Alternatives to consider: <br />1. Approve the final plat and assessment agreement as recommended by staff. <br />2. Approve modifications to either the final plat and/or assessment agreement as the Council sees necessary. <br />3. Deny the final plat and assessment agreement based on certain findings. <br />Funding Source: <br />All costs associated with the request are the responsibility of the applicant. <br />Recommendation: <br />Staff recommends approving the final plat and assessment agreement consistent with the Planning Commission's <br />preliminary plat recommendation. <br />Action: <br />Motion to Approve Resolution #23-011 approving final plat for Gile Addition and an assessment agreement . <br />
