Board Member <br /> <br />introduced the following resolutiOn and moved for its adoption: <br /> <br />RESOLUTION #02-10- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br /> WHEREAS, Bulow, Inc.,, hereinafter referred to as "Applicant," has properly applied for <br />a variance from Section 9.11.09 regarding landscape requirements adjacent to public roads and <br />Section 9.11.20 (4) regarding landscape buffering requirements when a commercial development <br />is adjacent to residential areas for development on the property generally located at the northwest <br />corner of Dysprosium St. and County Highway 116 and legally described as follows: <br /> <br />Lot 97, Block 1, and Outlot A, Mallard Ponds, Anoka County, Minnesota. <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, the Board of Adjustment met on October 3, 2002, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from landscape <br />requirements along the northern and western property lines of the Subject Property. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />Based on Findings of Fact # , a variance to the landscape requirements adjacent to <br />public roads, as established in Section 9.11.09 and 9.11.20 (4) of the Ramsey City Code, <br />is hereby granted for the development of a 6,000 square foot multi-tenant office builidng <br />on the Subject Property. <br />The variance will allow for the parking lot on the northern part of the property to be as <br />close as 10 feet from the right-of-way of 139th Lane. <br />The variance will allow for the parking lot on the eastern part of the Subject Property to <br />be as close as 20 feet from the property line. <br />The required amount of landscape along the eastern property line of the Subject Property, <br />is hereby waived. <br />The applicant is required to create a 40-foot landscape buffer on Lot 96, Block 1, Mallard <br />Ponds. Such landscaping shall be approved by the City of Ramsey and the Mallard Ponds <br />Homeowners Association. <br />No building, permit shall be issued until the Permittee as signed the variance and <br />reimbursed the City for all costs incurred in processing the application and has provided <br />the City of Ramsey and the Mallard Ponds Homeowners Association with an acceptable <br />landscaping plan. <br />The Permittee shall be responsible for all City costs incurred in processing the variance <br />request. <br /> <br /> <br />
