CASE #: <br /> <br />REQUEST FOR A VARIANCE TO LANDSCAPE AREA REQUIREMENTS; <br />CASE OF BULOW INC. <br /> By: Patrick Trudgeon, Principal Planner <br /> <br />Background: <br /> <br />Bulow Inc. is requesting a variance to the landscape area requirements as part of their application <br />for site plan approval of a 6,000 square foot multi-tenant office building located in the northwest <br />corner of Dysprosium St. and County highway 116. Specifically, the applicant is asking for a <br />variance from the requirement that developments shall provide a 20-foot landscaped area adjacent <br />to public roads. Also the applicant is asking for a variance from the requirement that a <br />commercial development shall provide a 40' landscaped buffer when adjacent to a residential <br />development, as is the case along the eastern border of the development property. The Planning <br />Commission will be reviewing the site plan for the proposed development at their October 3, 2002 <br />meeting. <br /> <br />The following items are enclosed for your review: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site plan showing location of variance <br />Proposed findings of fact <br />Proposed variance . <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff notified property owners within 350 feet of the subject <br />property of the request for variance and public hearing. <br /> <br />Observations: <br /> <br />As part of the office building development, the applicant will be constructing a parking lot. Along <br />139~ Lane, the parking lot will be as close as 10 feet to the edge of the fight-of-way. Code <br />requires that only green space can occupy the first twenty feet into the development property <br />when along a public road. The applicant has attempted to fit the required parking so it would not <br />encroach into the required green space, but has been unable to meet both the parking <br />requirements and the green space requirement. The applicant states that the fact that the lot is <br />surrounded on three sides by public streets and the size of the lot does not give them many <br />options and thus causes a hardship. The parking lot will be no closer than 24 feet to the back of <br />curb of 139a' Lane. <br /> <br />In the same vein, the developer is unable to meet 40-foot landscape buffer requirement on the <br />eastern property line. Once again, the fact that the property is surrounded on three sides by public <br />roads limits where parking can located. Therefore, the only place to locate the majority of the <br /> <br /> <br />
