8. That the property is surrounded by three roads; 139th Lane to the north, Dysprosium St. NW <br /> to the west, and County Highway 116 to the south. <br /> <br />The applicant states that due to three roads surrounding the property and the required <br />setbacks, the size of the lot, and the required parking standards, a hardship is created in trying <br />to develop the lot. <br /> <br />10. That the Applicant is requesting a variance to the 20-foot landscape buffer requirement along <br /> 139th Lane and from the 40-foot landscape buffer along the eastern property line due to this <br /> hardship. <br /> <br />11. That the Applicant has stated the variance requested is the minimum variance needed to <br /> alleviate the hardship. The Applicant will create a minimum of a 10-foot buffer along 139t~ <br /> Lane and a 20-foot buffer along the eastern property line. <br /> <br />12. That the Applicant has stated that they will be planting a 40-foot landscaping area on Lot 96, <br /> Block 1, Mallard Ponds. <br /> <br />13. That if granted, the variance will/will not impair an adequate supply of light and air to adjacent <br /> property. <br /> <br />14. That if granted, the variance will/will not endanger the public safety. <br /> <br />15. That if granted, the variance, will/will not unreasonably diminish property values in the <br /> neighborhood. <br /> <br />16. That if granted, the variance will/will not violate the intent of the Comprehensive Plan. <br /> <br />17. That, if granted, the variance will/will not grant the Applicants any special privileges that is <br /> denied to other owners of land in the same district. <br /> <br />18. That undue hardship will/will not result if the variance request is denied due to the existence <br /> of special conditions and circumstances which are peculiar to the land and which are not <br /> applicable to other lands in the same district. <br /> <br />19.
