CASE <br /> <br />REQUEST FOR A VARIANCE FROM MAXIMUM FRONT YARD SETBACK <br />REQUIRMENTS; CASE OF RAMDANCE LLC <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />Ramdance LLC is proposing to develop Outlot I of Ramsey Town Center. The first phase of the <br />development will include a 54,000 square foot grocery store and an 18,000 square foot retail <br />building. The fbllowing items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site Plan <br />Proposed resolution to adopt findings of fact <br />Proposed resolution to approve the variance <br /> <br />Observations: <br /> <br />The subject property is zoned TC-2 Town Center Commercial. Section 9.20.25 (3) (b) of City <br />Code establishrs a minimum front yard setback of 0 feet and a maximum front yard setback of 15 <br />feet. The Town Center Development Guidelines for the TC-2 Sub-District encoUrages large <br />scale retail to locate adjacent to the Burlington Northern Santa Fe railroad corridor. Any attempt <br />to locate the front of the grocery store within 30 feet of the street right-of-way would result in the <br />loading dock areas being located in the midst of the public parking area. Placement of the store <br />adjacent to the railroad results in a front yard setback of approximately 300 feet. <br /> <br />The sketch plan for the development of the grocery store that was approved by the Planning <br />Commission on May 6 and the City Council on May 11, 2004 showed the grocery store being <br />located adjacent to the railroad, along the south property line. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the variance. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #04-07-__ adopting Findings of Fact # relating to a request <br />fi'om Ramdance [,LC for a variance to maximum front yard setbacks for the proposed grocery <br />store to be constructed in the TC-2 Sub-District of the Ramsey Town Center. <br /> <br />-and- <br /> <br />Motion to approve the request for a variance to maximum front yard setback requirements for <br />Ramdance LLC, based on the findil~gs of fact, and adopt Resolution #04-07- declaring terms <br />of same. <br /> <br />Review Checklist: <br /> <br />Asst.
