A Charter Amendment was passed by the citizens <br />of Ramsey regarding the issue and his understanding- was that the City Attorney advised that <br />Council that they should draft an ordinance reflecting the intent of the Charter Amendment. <br />City Attorney Goodrich replied that that was true. <br />Mr. Lichter stated that it was is understanding and belief that all the Councilmem ers <br />h h nd g have <br />b h <br />supported density transitioning in their campaign literature and requested that they keep their <br />promise or let the voters decide the issue. <br />Councilmember Hendriksen inquired as to where the City currently stands if a developer were to <br />come into the City and want to develop a parcel of land. <br />' City Attorney Goodrich replied that currently there is not a density transition ordinance in place <br />or enforcing Charter Amendment. Currently there are things that staff has done in regards to <br />buffering that they could continue to do. <br />Councilmember Hendriksen stated that a developer who wanted to max his profit could say they <br />did not want to follow those suggestions made by staff. <br />City Attorney Goodrich replied that if the development complies with development standards <br />then they would not be obligated. <br />Councilmember Hendriksen inquired as where they stand in regards to the density transition <br />ordinance introduced in December. <br />City Attorney Goodrich replied that it is still available for adoption. <br />Councilmember Hendriksen inquired if it was true that when the citizens pass something the <br />Council has fewer options in changing those standards in the future. <br />City Attorney Goodrich and Mr. Thomson agreed with Councilmember Hendriksen's statement. <br />Councilmember Hendriksen inquired if for example the City of Richfield is taken to court and <br />court determines that the issue Mr. Thomson brought up did not upstand to the level. of <br />manifestly unconstitutional and it was placed on the ballot would the same apply to their issue. <br />City Attorney Goodrich replied yes that it would impact the legal opinion given to the Council. <br />Councilmember Hendriksen inquired if it was possible that the issue could be placed on the <br />ballot in Ramsey, based on what happens in Richfield. <br />City Council /March 27, 2001 <br />Page 13 of 22 <br />-31- <br />
