Norman <br />Date: 05/04/01 <br />Re: Partial Release; Rivers Bend 3 Addition <br />The City has received a request for partial release of 1993 Development Agreement and Special <br />Assessment Agreement on the northerly portion of Outlot C, River's Bend 3 Addition, which was <br />recently replatted as Lot 1, Block 1, Holiday Acres. At the time the subject property was replatted and <br />transferred to the developers of the Holiday Station Store, all obligations on the property were satisfied. <br />The remainder of River's Bend 3 Addition would continue to be encumbered by the 1993 agreements. <br />Staff is recommending that City Council authorize the Mayor and City Administrator to execute the <br />Partial Release for Lot 1, Block 1, Holiday Acres from the 1993 Development Agreement and Special <br />Assessment Agreement filed at Anoka County as Documents 1053543 and 1053544 on July 16, 1993 <br />and June 29, 1993 respectively. <br />Also, at the time the Holiday site was platted and site plan approval was granted, the name of record <br />was Lyndale Terminals. Since then there has been a name change to Cass Oil Co. Staff is <br />recommending Council approval to make the appropriate changes to the development agreement and <br />development permit. <br />—55— <br />
