23. Water Quality. Surface and ground waters originating outside and passing through or <br />adjacent to the Site and runoff water discharged from the Site shall, at its point of departure <br />I from the Site, meet all applicable federal and state water quality standards as they exist from <br />time to time during the period of this CUP. The operator shall perform any water treatment <br />necessary to comply with applicable state and federal water quality standards as they exist <br />from time to time during the period of this CUP. Grading and drainage plans shall be <br />submitted to and approved by the City Engineer. Berming shall be installed as necessary to <br />control run -off. <br />24. Screening. The Permit Holder agrees to screen the aluminum processing facility from <br />any public street. Such screening shall be achieved using grading, landscape elements, <br />and /or plant materials which will achieve up to 90% opacity.. Supplemental screening of <br />' the Site may be ordered by the City to comply with the then current screening requirements <br />for outside storage on industrial property. <br />' 25. Off- Street Parking. Off - street parking shall be provided such that there is at least one <br />parking space for each employee on the maximum working shift plus three spaces for <br />visitor parking. <br />26. Surfacing of Work Areas. All storage areas, parking areas and driveway areas shall <br />be surfaced with bituminous or concrete. <br />27. Building Permits. No construction or remodeling of any structures shall commence <br />prior to the issuance of a building permit by the City Building Official and site plan <br />approval by the City Council. <br />28. Electrical. The building's electrical system must be inspected and brought up to code <br />within 30 days of this CUP. An affidavit of compliance shall be filed with the City within <br />five working days after final inspection. <br />29. Sanitary Sewer. The Permit Holder shall petition for City sewer and water within 30 <br />days of the date of action on this CUP. In the event that the petition fails, the Permit <br />Holder shall install an on -site system or submit an alternative sewage handling treatment <br />plan for Council approval. <br />30. Scope and Conduct of Operations. The operations permitted by this CUP may be <br />performed on the Subject Property in conformance with existing statutory and regulatory <br />authority and requirements of the City, Anoka County, Minnesota ( "County "), and the <br />Minnesota Pollution Control Agency ( "MPCA "). <br />31. Furnaces. This permit shall be issued allowin g for the use of two melt furnaces as <br />described by the applicant in the CUP application support information. An increase in <br />furnace capacity or a third melt furnace shall not be added to the operation without <br />application and approval of a new CUP. <br />32. Closure Due to CUP Revocation, Other \ Circumstances. In the event this CUP <br />is revoked or the Permit Holder closes operation of the aluminum processing operation for <br />any reason, including but without limitation, order of the court or other agency of <br />competent jurisdiction, bankruptcy, insolvency, or abandonment, the Permit Holder shall <br />immediately proceed to remove all feedstock and other material from the site. In the event <br />the Permit Holder fails to comply with the terms of this CUP, the City may, upon 30 days' <br />written notice to the Permit Holder enter into the property and perform all such obligations, <br />the costs of which shall be borne by the Permit Holder or, in default thereof, by its surety. <br />11 <br />_87_ <br />
