Authority, oversight, and definitions <br />A. Authority to regulate <br />All cities are authorized to provide for or regulate by ordinance the disposal <br />of sewage, garbage, and other refuse. This broad grant of police power <br />authorizes cities to regulate the collection and disposal of solid waste. <br />B. Authority to acquire, construct, and operate <br />solid waste facilities —first class cities <br />First class cities (Minneapolis, St. Paul, Duluth, and Rochester) are <br />authorized: <br />• To acquire by purchase or condemnation lands on which to build plants <br />for the destruction of garbage and other refuse. <br />• To purchase, build, operate, and maintain such plants for the destruction <br />of garbage and other refuse. <br />• To provide for the collection of all such garbage or refuse and its <br />delivery to destruction plants or other places. <br />• To pay and contract to pay for the same in such annual installments and <br />at such a rate of interest on deferred payments as the city council <br />determines. <br />Each of these actions must be authorized by at least a three -fourths vote of <br />all members of the city council. First class cities have additional authority <br />and restrictions regarding solid waste management. <br />C. State oversight <br />Before the 1970s, open burning and open dumping were the most common <br />forms of solid waste management. <br />This material is provided as general information and is not a substitute for legal advice.
