CC Regular Session <br />Meeting Date: 03/ 11 /2025 <br />Primary Strategic Plan Initiative: Promote economic growth and development. <br />Title: <br />Adopt Resolution #25-053 Approving the Development Agreement for Emerald Estates, Located on 181st <br />Avenue West of Xenolith Street (Project No. 24-123); Case of Alan &Joni Greenwaldt <br />Purpose/Background: <br />On February 25, 2025, the City Council approved the Final Plat of Emerald Estates, a thirteen (13) lot rural <br />residential subdivision, located on the south side of 181 st Avenue, west of Xenolith Street (the "Subject <br />Property"). Each of the lots will be custom -graded and built. A Development Agreement is necessary to address <br />financial obligations (surety amounts, development fees) and to specify what additional information must be <br />supplied with each building permit for new dwellings on the newly created lots. The Development Agreement for <br />Emerald Estates is attached to this case. <br />Notification: <br />Notification is not required. <br />Time Frame/Observations/Alternatives: <br />The Emerald Estates subdivision will be a custom design/build project. Thus, some of the standard subdivision <br />review of civil engineering plans (e.g. grading, drainage, erosion control, tree preservation, etc.) will now be <br />completed as Staff reviews individual building permits for homes on each of the thirteen (13) lots. Therefore, <br />some of the civil plan review that is typically done as part of the Preliminary Plat and Final Plat plan review will <br />now need to be done as part of the building permit review. Due to this, Staff has added language to the <br />Development Agreement outlining what additional information must be included with each building permit <br />application for a new dwelling. Additionally, since the review of lot -specific grading, drainage, erosion control <br />and tree preservation, Staff also expanded the list of required data needed at the time of building permit <br />application and prior to issuance of a Certificate of Occupancy for any new home. <br />Funding Source: <br />The Applicant is responsible for all costs associated with this request. <br />Recommendation: <br />Staff recommends approving the Development Agreement. <br />Outcome/Action: <br />Motion to adopt Resolution #25-053 approving the Development Agreement for Emerald Estates. <br />Attachments <br />Site Location Map <br />Emerald Estates Final Plat <br />Development Agreement <br />Resolution #25-053: Development Agreement <br />
