3. This Agreement is non-transferrable. <br />4. The Permittee agrees to protect, indemnify and hold harmless the Owner from and <br />against any and all claims, demands, suits, liability and expense, by reason of loss or <br />damage to any property or bodily injury to any person whatsoever, that may arise from <br />the Existing Driveway. <br />5. The terms and conditions of this Agreement shall be binding upon, and shall inure to the <br />benefit of, the parties hereto and their respective successors and assigns. <br />6. This Agreement shall be recorded against both the Permittee Property and the Owner <br />Property. <br />IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed as of the <br />day and year first above written. <br />
