<br />- 2 - <br /> <br />..order to. accomodate the Airport and its required restricted <br />zones, a comprehensive plan amendment will most likely be <br />required as will zoning ordinance amendments. Therefore, the <br />interim ordinance imposing a moratorium as described in MSA <br />462.355 subd. 4 above, would be appropriate even though the <br />airport property and other affected property is currently <br />privately owned. Please note that the moratorium is two and one- <br />half (2 1/2) years. <br /> <br />One note of caution is that a moratorium such as being <br />comtemplated will affect property owners' rights to develop <br />and/or sell their property. Therefore, depending on the exact <br />interim ordinance adopted, the City could become liable to <br />damages if a property owner is denied the right to develop andl <br />or sell his property. This then means that the City should be <br />reasonably certain that it intends to proceed with the Airport <br />project prior to adoption of the above referred to interim <br />(moratorium) ordinance. <br /> <br />The interim ordinance can provide for moratorium restrictions <br />similar to those which are anticipated to be included in the <br />final Airport Zoning Ordinance. <br /> <br />. <br /> <br />For your information, I am attaching a proposed interim <br />ordinance. In order to pass this ordinance, the City's Planning <br />Commission must conduct a public hearing after ten (10) days' <br />published notice. Upon receipt of the Planning Commission's <br />finalizing and recommendation, the Council can act on the <br />ordinance. If the Council votes by a four-fifths (4/5) majority <br />to adopt the ordinance, it becomes e~fective thirty (30) days <br />-after its first publication, unless during said thirty (30) day <br />period a citizen's petition is received by the Council asking for <br />a referendum on the subject. <br /> <br />. <br />
