Numerous
lots were platted as park areas. At that time, the City was a township and
not scrutinizing as well as it could have; Outlot B was dedicated as park
but it was not reflected as that on the plat map. In order for anyone at
-the City to be able to determine that Outlot was park, they would have had
to review the dedication sheet on the plat. The developer who platted
Countryside Estates subsequently sold Outlot B and it began tobe treated
as if it were not a park. Anoka County was taxing the property and no one
was paying taxes on it. Ramsey was notified by Anoka County that Outlot B
was listed as tax forfeit property; the City paid the minimum amount of
taxes in order to retain the south half of the lot for drainage purposes
and the person who allegedly owned the property kept the north half. The
north half of Outlot B was then sold to one or two other individuals with
lawyers giving title opinions and the tit1e company issuing title
insurance. Therefore, through a series of errors on the part of many, the
property began to be used as non-park property. In last 1987, or early
1988~ the City issued a building permit for the north half of Outlot Band
a home got constructed. That home was constructed because the title
company issued a title policy assuring the lot as private property. This
has resulted in a situation where there is a private, residential home
existing on park property. The City has been asked to ~onsider vacating
it's interest in the property. There are several other properties in that
area that Can be used for parks. It is very doubtful that the courts would
City Council Public Hearing/June 28, 1988

II
