Voting No: None. <br /> <br />Case #13: Adopt Amendment To Section 170.01 Of The Ramsey City Code <br />Establishin~ A Moratorium On The Sitin~ Of Landfills: <br /> <br />Mr. Hartley stated that the purpose of the moratorium is to give the City <br />the opportunity to draft an ordinance that would be consistent with MPCA, <br />Metro Council and Anoka County regulations relating to the siting of <br />landfills. According to state law, if Ramsey has such an ordinance in <br />place, then the comments of Ramsey will be taken into consideration if the <br />county chooses to site a landfili in the metro area. The City does not <br />have the right to put something in place that would interfere with the <br />siting process but it does have the right to make reasonable requirements <br />on construction and operation of a landfill. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Cox to <br />adopt Ordinance #88-7 establishing a moratorium on the siting of landfills <br />in Ramsey. (Refer to ordinance file for Ordinance #88-7). <br /> <br />Further Discussion: Councilmember Cox inquired if this ordinance conflicts <br />with the agreement the City entered into for vertical expansion of the <br />landfill. Mr. Hartley stated that the proposed ordinance affects the <br />siting of landfills and the agreement with Waste ~~nagement applies only to <br />the expansion and operation of an existing landfill. <br /> <br />- . <br />J <br /> <br />Motion carried. Voting No: None. <br /> <br />Case f15: Volunteer Fire Department No Smokin~ Policy: <br /> <br />Mr. Hartley stated that the Fire Safety Committee is recommending that <br />Council adopt a no smoking policy for all members of the Ramsey Volunteer <br />Fire Department. A Minnesota statute states that firefighters unable to <br />perform duties in the department by reason of a disabling cancer of a type <br />caused by exposure to heat or suspected carcinogen is presumed to have an <br />occupational illness. The Fire Safety Committee feels that due to the high <br />exposure to heat, smoke, and other carcinogens firefighters may experience, <br />and the increased risk of smokers contracting a related disease, a no <br />smoking policy would minimize the dollars spent on Workers.... Compensation <br />claims made due to non-job-related illness. The concerns of the Fire <br />Safety Committee are that to adopt this poiiey may affect the number of <br />people that will be eligible to be volunteer firefighters; to not adopt the <br />policy leaves the the city....s worker....s compensation insurance very <br />vulnerable to claims. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Cox to adopt <br />Resolution #88-125 to establish a no smoking policy for all members of the <br />Ramsey Volunteer Fire Department.
