<br />PROPOSED FINDINGS OF FACT <br />MR. PETER BARTHOLD <br />15710 ST. FRANCIS BLVD. N.W. <br /> <br />1. That Mr. Peter Barthold, hereinafter referred to as "Appl icant", has <br />properly applied for a Board of Adjustment Variance from Section <br />170.015G of the City Code. <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Section 170.013G of the City Code on December 6, <br />1988 and that said public hearing was properly advertised and that the <br />minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br /> <br />3. That the subject property is generally known at 15710 St. Francis Blvd. <br />N.W. and is legally described as follows: <br /> <br />Lot 2, Block 1. J.P.J.V Addition, Anoka County, Minnesota <br /> <br />4. That the subject property is located in the R-lR Residential District <br />and is approximately 6.5 acres in size. <br /> <br />5. That Section 170.015G of the City Code specifies that no accessory <br />structure shall be constructed nearer the front lot line than the <br />principal structure and shall not exceed 16 feet in height. <br /> <br />6. That the principal structure at 15710 St. Francis Blvd. N.W. is located <br />approximately 700 feet from the front property line and tbe Appl icant <br />is proposing to construct tbe accessory structure approximately 650 <br />feet from tbe front property line. <br /> <br />7. That the proposed accessory structure will be _ in beight. <br /> <br />8. That there are exceptional conditions applying to the the property that <br />do not generally apply to otber properties in tbe district. Namely, <br />tbat the placement of an accessory structure on the subject property is <br />limited by low elevations and mature tree growtb. <br /> <br />9. That the Applicant bas stated that such a variance is necessary for tbe <br />preservation of a substantial property right similar to that possessed <br />by other properties in the area. <br /> <br />10. Tbat tbe exceptional conditions (low elevations and mature tree growth) <br />do not result from tbe actions of tbe Applicant. <br /> <br />11. That if granted, tbe variance will not grant tbe Applicant any special <br />privilege that is denied to other owners of land in the R-1R <br />Residential District. <br /> <br />12. That the variance requested is the minimum variance which would <br />alleviate the hardship. <br /> <br />13. That if granted, the variance will not be materially detrimental to the <br />purposes of the Zoning Chapter. <br /> <br />7 <br />
