REOUEST FOR METES AND BClJNDS SUBDIVISION OF ItJr 4, BLOCK 1, VCLTIN'S OAK HILL ESTATES; CASE OF MR. DM.,E VOLTIN Background: Mr. Dale Voltin is requesting Council approval of a metes and bounds subdivision of that portion of Lot 4, Block 1, Voltin's Oak Hill Estates lying north of County Ditch #3 from that portion of the lot south of the drainage ditch. This subdivision would create a landlocked parcel. At the time Voltin's Oak Hill Estates was platted, the City Council stipulated in the development agreement that Lot 4 could not be developed until southerly access Lot 4 was provided by the developer. Mr. Voltin is now requesting approval of the subdivision of this lot as the owner (Mr. David Schulte) of the southern half of Lot 4 also owns the property immediately south which abutts Hall-Anderson Estates and has access from 160th Lane N.W. Mr. Schulte has stated that he would provide to the City a 66 foot wide road easement extending fram l60th Lane N.W. to the southern portion of Lot 4. For your information, attached are the following items: a. Site location map b. Proposed subdivision Reconmendation: If Mr. Schulte agrees: 1) to provide a 66 foot wide road easement to the City extending from 160th Lane N.W. to the southern portion of Lot 4; and 2) that no building permits shall be issued or subdivision allowed until the road is accepted by the City as a City road, staff recommends that the subdivision be approved . Council Action: Will be based on your discussion.
