5 Minutes CASE 120: HAMILrowH<LASEK AND IMS PROPERl'Y ACQUISITION .PRcx::EEDImS By: Bill Goodrich, City Attorney Background: By Resolution #88-14 and Resolution #88-30 the City Council authorized condemnation actions to acquire property for utilities and street improvements south of U. S. Highway #10 and water tower and Dysprosium Street N.W. extensions respectively. Both of these resolutions authorized the actions pursuant to MSA 117 .042 which is known as the "Quick Take" Statute. Pr ior to the City taking title and possession, the Statute requires the City to "pay to the owner or deposit with the Court an amount equal to the petitioner's (City's) approved appraisal of value. Resolution #88...14 relates to the property. acquisition fran Mr. Winslow Holasek and Mrs. Laura Hamilton. The City's appraisal of value for this property is $52,941.89. Resolution #88-30 relates to the pro~rty a(Xfuisition from the estate of Mr. Daniel Laws. The City's appraisal of value for this property is $33,218.23. Recommendation': Council Action: Motion to: Approve the appraisal of the Hamilton/Holasek property as described in Resolution #88-14 in the amount of $52,941.89 and to authorize the City's finance department to issue a check in said amount payable either to the Anoka County District Court Administrator or the property owners as directed by the City Attorney. -and- Motion to: Approve the appraisal of the Laws property as described in Resolution #88-30 in the amount of $33,218.23 and to authorize the City's finance department to issue a check in said amount payable either to the Anoka County District Court Administrator or the property owner as directed by the City Attorney.
