TIKJIBY SHAY By: Anne Norris, Community Developnent Director Background: Mr. Timothy Shay is requesting a conditional use permit to construct an advertising sign on his vacant proI=erty at 6745 - 138th Avenue N.W. Mr. Shay is proposing to construct an advertising sign approximately 8' x 16' (128 square feet) in size. There is also currently a 9' x 16' sign located on the property. The sign would be on the proI=ertyfor no more than five years, at which tire Mr. Shay plans to develop the proI=erty. Enclosed are the following items for your information: a) Application b) Site location map c) Section 170.054 of the City Code d) Proposed findings of fact e) Pro};X)sed conditional use permit Cbservations: Section 170.054 of the City Code states that free standing advertising signs shall only be I=ermitted with a conditional use permit and only on p:ircels where the subject activity is located or within 2,500 feet of the p:l.rce1 on which the subject activity is located. The City Attorney has determined that the City cannot issue a conditional use I=ermit for an advertising sign if it does not meet this rEqui rement. The Planning and Zoning Commission conducted a public hearing on Mr. Shay's request on March 1, 1988. en March 3, 1988 the Commission recormnended that Mr. Shay's request be denied. Recommendation: COuncil Action: Motion to: Adopt Findings of Fact 00_ relating to Mr. Timothy Shay's request for a conditional use permit. -and- l-1otion to: Approve/deny Mr. Timothy Shay's request for a conditional use permit.
