In the event that a police <br />officer or dni~al control officer hds probable <br />cause to believe tlldt a dangerous dog ;s being <br />harDored or houseti in violdtion of ~ectioll (j) <br />above, the police officer or animal control offit=r <br />Inay seize and impound the dangerous dog pending <br />trial. <br /> <br />110.0316 Failure to Restrain an attack by a LJog. It shall be <br />unlawful for an o\~ner to tall to restraln a dog frolil <br />inflicting or attempting to inflict bodily injury to any <br />person or other animal. Violation of this section shall ~e a <br />misdemeanor. The Court upon a finding of the defendant1s <br />guilt hereunder, is authorized to order, as part of the <br />disposition of the case, that the animal be destroyed based <br />on a written order containing one or more of the following <br />findings of fact: <br /> <br />1. The animal is dangerous as demonstrated by a V1C10US <br />a t t a c k, a nun pro v 0 ked a t t a c Ie, a n a t t d C k wit fl 0 u t \<1 a r n i ny, <br />or multiple attacks; or <br /> <br />2. The owner of the animal has demonstrated an inability <br />or unwillingness to control the animal in order to <br />pre v e n tin j u r y top e r s 0 !1 S, 0 rot i1 era n i mal . <br />, <br /> <br />If the Court does not order the destruction of the dog, the <br />Court, as an alternative, may order the defendant to provide, <br />and show proof to the Court of public liability insurance in <br />the minimun a~ount of S300,OOO.UO. <br /> <br />110.0317 Stopping an Attack. If any police Ufficer or Animal <br />Control ufficer is vlitness to an attack by a doy UpOl1 a <br />person or another animal, the officer may take \'/:1dtever means <br />he or she dee~s appropriate to bring the attack to an end and <br />prevent further injury. to the victim. <br /> <br />110.0318 Jogs Disturbing the Peace. It shall be unla~ful for <br />any person to own, ~(eep, have in possession) or harbor any <br />dog \vhich howls, yelps, or barks to the reasonable annoyance <br />of another ;:Jerson or persons. Any person viola:ing this <br />section, who upon first requested by a rolice Officer or <br />Animal Control Officer to stop or pre~ent the annoyance) and <br />refuses tc comply Hith the request v/ill be issued a citation <br />or arrested in accordance with Minnesota Rules of Criminal <br />Procedure, and) if the officer deems it necessary to stop the <br />annoyance, may have the dog taken to the City animal pound. <br />Any dog placed in the pound may be reclaimed by the owner <br />upon pay~ent of the fee presecribed in section 110.03Y, and <br /> <br />15 <br />
