Mr. Ed Hamilton - 6615 Hwy. #10 N.W. - Stated that he is opposed to the operation locating on the proposed site. The Commission proceeded to review the proposed findings of fact. Motion by Commissioner Shumway and seconded by Commissioner Howell to recommend that City Council adopt the proposed findings of fact relating to Commercial Asphalt Company's request for a conditional use permit to establish a bituminous asphalt plant in the I-I Industrial District. Further Discussion: Commissioner Hendriksen recalled that some of the citizens made comments during the Flintwood 5th Addition public hearing earlier this evening regarding the odor that is emitted from Commercial's operation currently located in that area; 8uggested adding language to items 17 and 18 to indicate concern for odors as well as air qual ity and another item 24 to indicate comments made during the Flintwood 5 public hearing regarding odor from the existing asphalt operation across the street. Mr. Data stated tbat he did comment during the Flintwood 5 pub lie heari,ng that noise and odor from the .!lspbal t operation is a good reason not to develop apartment buildings in that area. Amendment by Commissioner Hendriksen and seconded by Comissioner Howell to add the following to the proposed findings of fact: Item #24: That the Planning and Zoning Commission has received several comments regarding the potential odor from the proposed site and existing odor at the existing site. Amendment carried. Voting Yes: Chairman Zimmermant Commissioners Shumway, Hendriksen, LaDue, Holm, Howell and Terry. Voting No: None. Motion carried. Voting Yes: Cbairman Zimmerma~. Commissioners Shumway, Hendriksent LaDue, Holm, Howell and Terry. Voting No: None. Ms. Norris stated that she has not yet drafted a proposed conditional use permit for P&Z consideration. Motion by Commissioner Holm and seconded by Coomissioner Shumway to table a decision regarding Commerci~l Asphalt C~?any's request for a conditional use permit until city staff bas drafted same. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Sbumway, Hendriksen, LaDue, Bolm, Bowell and Terry. Voting No: None. Case '2: Request For Sketch Plan Review: Case Of Mr. John Rambosek. Mr. Dale Voltin and Mr. DE~e Schulte: Ms. Norris stated that per the Commission's direction, Mr. Voltin, Mr. Schulte and Mr. Rambosek are present to coordinate the platting of Voltin's Oak Rill Estates and Rambosek's Red Oaks and EtE.:f bas research the status of an easement proposed to provide soutber access to Lot 4.
