they are able to acquire insurance for a private railroad crossing at Dayton Port. The cost for the insurance is high and North Fork is concerned that the City will be able to accomplish a public crossing at Dayton Port in the near future. Mr. Hartley stated that he informed North Fork that it is the City's policy to continue to pursue Dayton Port as a public crossing and with the greatest of success, it will take at least one year. North Fork will be coming to the City for an amendment to their conditional use permit to reflect the new traffic routE:: utilizing the private crossing at Dayton Port. Case 112: Consider Reschedulin~ December 22. 1987 Re~ular Citv Council Meetin~: Council consensus was that the next regular City Council meeting will be on the regularly scheduled 4th Tuesday, December 22, 1987. Case #13: Status Of Certificate Of Need For Anoke Landfill: Mr. Hartley stated that he has received written notice from Metro Council indicatin.g that Waste Management of Minnesota, Inc. has applied for an extension of their certificate of need due to expire in June, 1988. Metro Council staff has indicated that ,.there continues ,to be a need for additional landfill capacity and recommends approval of the request for an extension.. Stephen Keefe, Metro Council Chairman, indicates that the need for additional landfilling is subsiding and there may not be a need to site new landfills or expand existing landfills. Mr. Rartley requested direction from City Council regarding Ramsey's position on Waste Management's request for an extension of their certificate of need; December 16 is the only opportunity Ramsey will have to make comments. A discussion ensued regarding Ramsey's position on landfill issues having no affect on higher agencies in the past; cooperation on the certificate of need could result in accomplishing environmental improvements with the proposed vertical expansion at the Anoka Land:i1l. Mr. Goodrich suggested tbat if Council feels their comments have no impact, they should not take an official stand on the request for extension of the certificate of need.
