That the accessory building constructed on the Subject Property shall not be located any <br />closer than forty (40) feet from the front property line. <br /> <br />3. That the exterior finish of the proposed building shall match that of the principal building and <br />include architectural features such as soffit, fascia, and eave overhang as well. <br /> <br />4. That the Permittee shall be responsible for all costs incurred in administering and enforcing <br />this variance. <br /> <br />5. That the Permittee shall obtain all necessary permits prior to commencing any construction of <br />the accessory building. <br /> <br />6. That the accessory building shall be used for storage of personal property and that no <br />commercial activity of any type shall be permitted in said structure unless such use is <br />permitted in accordance with City Code. <br /> <br />7. That a minimum clearance of thirteen and a half (13.5) feet from the Open Conductor power <br />line and the accessory building shall be maintained in accordance with the National Electrical <br />Safety Code C2-2002. <br /> <br />8. That this Variance shall automatically expire if the use is not initiated by September 7,2007 <br />and issuance of the building permit shall constitute initiation. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Trites Rolle, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Nixt <br />Board Member Trites Rolle <br />Board Member Cleveland <br />Board Member Hunt <br />Board Member Levine <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />and the following abstained: <br /> <br />None <br /> <br />and the following were absent: <br /> <br />Board Member Brauer <br />Board Member Van Scoy <br /> <br />RESOLUTION #06-09-273 <br />Page 2 of3 <br />
