Councilmember Beyer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-11-251 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF CERTAIN PERMANENT <br />AND TEMPORARY EASEMENTS BY USE OF MSA §117.011 AND §117.042 <br />FOR UTILITY PURPOSES FOR IMPROVEMENT PROJECT #91-01 <br /> <br /> WHEREAS, the City of Ramsey proposed to construct a sanitary sewer and water main <br />improvements known as Improvement Project gO 1-01; and <br /> <br /> WHEREAS, the improvement consists of constructing sanitary sewer and water mains to <br />serve properties in the City which are necessary for the safety and convenience of the residents of <br />the City of Ramsey; and <br /> <br /> WHEREAS, permanent easements and temporary construction easements are required <br />over certain lands for improvement construction; and <br /> <br /> WHEREAS, the City of Ramsey has the authority to acquire easements for said utilities <br />by eminent domain pursuant to Minnesota Statutes § 117; and <br /> <br /> WHEREAS, the property owners from whom easements are required have been <br />identified by the City of Ramsey as follows: <br /> <br />PIN Owner Easement Description <br /> <br />35-32-25-31-0009 <br /> <br />Guy Property <br />Thomas Gedde <br />(Trustee) <br /> <br />A permanent easement for utility and drainage <br />purposes over, under and across the southern <br />20.00 feet of the following described property: <br /> <br />Lot 22, AUDITORS SUBDIVISION 96, <br />Excepting that part of said Lot 22 described as <br />follows: The northeasterly 206.43 feet of the <br />southeasterly 211.02 feet as measured at right <br />angles to the northeasterly and southeasterly lines <br />of said Lot 22 respectively; subject to easement of <br />record. <br /> <br />Together with a temporary construction easement <br />over, under and across the north 30.00 feet of the <br />south 50.00 feet of the above described property. <br /> <br /> WHEREAS, the City Council finds that it is in the City's best interest that the project <br />proceed as quickly as possible and therefore, the City needs to acquire possession of the necessary <br />parcels prior to filing an award by the Court Appointed Commissioners; and <br /> <br /> WHEREAS, the City has the right to acquire easements prior to the filing of an award by <br />the Court Appointed Commissioners, pursuant to Minnesota Statutes § 117.011 and § 117.042. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br /> <br />
