Councilmember Peterson introduced the following resolution and moved for its adoption: RESOLUTION #91-12-261 RESOLUTION AUTHORIZING ACQUISITION AND TEMPORARY EASEMENTS BY USE OF FOR UTILITY AND STREET PURPOSES OF CERTAIN PERMANENT MSA §117.011 AND {}117.042 WHEREAS, the City of Ramsey proposed to construct a sanitary sewer and water main improvements known as Improvement Project #91-01; and WHEREAS, the improvement consists of constructing sanitary sewer and water mains to serve properties in the City which are necessary for the safety and convenience of the residents of the City of Ramsey; and WHEREAS, permanent easements and temporary construction easements are required over certain lands for improvement construction; and WHEREAS, the City of Ramsey has installed an interceptor sewer main over lands located within the Northwest Quarter of Section 35, Township 32, Range 25, Anoka County, Minnesota; and WHEREAS, the alignment of this existing interceptor sewer main is coincident with the mute for the future extension of McKinley Street; and WHEREAS, The City of Ramsey finds it necessary to acquke right-of-way for said McKinley Street; and WHEREAS, the City of Ramsey has the authority to acquire easements for said utilities by eminent domain pursuant to Minnesota Statutes § 117; and WHEREAS, the property owners from whom easements are required have been identified by the City of Ramsey as follows: PIN Owner Easement Description 35-32-25-21-0001 Leonard J. Spoehn An 80 foot wide strip of land for fight-of-way purposes, the centerline of said strip of land is as follows: Beginning at the intersection of the west line of the east 10 rods of the Northwest Quarter of Section 35, Township 32, Range 25, Anoka County, Minnesota, and a line 390.00 feet northeasterly of as measured at a right angle to and parallel with the northerly right- of-way of the Burlington Northern Railroad; thence northwesterly parallel with said northerly right-of- way to the east line of Outlot A, RAMSEY 67 INDUSTRIAL PARK FIRST ADDITION, Anoka County, Minnesota and said centerline there terminating. The northerly and southerly lines of said easement are to be prolonged or shortened to terminate on the west line of the east 10 rods of said Northwest Quarter and the east line of said Outlot.
