Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-12-261 <br /> <br />RESOLUTION AUTHORIZING ACQUISITION <br />AND TEMPORARY EASEMENTS BY USE OF <br />FOR UTILITY AND STREET PURPOSES <br /> <br />OF CERTAIN PERMANENT <br />MSA §117.011 AND {}117.042 <br /> <br /> WHEREAS, the City of Ramsey proposed to construct a sanitary sewer and water main <br />improvements known as Improvement Project #91-01; and <br /> <br /> WHEREAS, the improvement consists of constructing sanitary sewer and water mains to <br />serve properties in the City which are necessary for the safety and convenience of the residents of <br />the City of Ramsey; and <br /> <br /> WHEREAS, permanent easements and temporary construction easements are required <br />over certain lands for improvement construction; and <br /> <br /> WHEREAS, the City of Ramsey has installed an interceptor sewer main over lands <br />located within the Northwest Quarter of Section 35, Township 32, Range 25, Anoka County, <br />Minnesota; and <br /> <br /> WHEREAS, the alignment of this existing interceptor sewer main is coincident with the <br />mute for the future extension of McKinley Street; and <br /> <br /> WHEREAS, The City of Ramsey finds it necessary to acquke right-of-way for said <br />McKinley Street; and <br /> <br /> WHEREAS, the City of Ramsey has the authority to acquire easements for said utilities <br />by eminent domain pursuant to Minnesota Statutes § 117; and <br /> <br /> WHEREAS, the property owners from whom easements are required have been <br />identified by the City of Ramsey as follows: <br /> <br />PIN Owner Easement Description <br /> <br />35-32-25-21-0001 <br /> <br />Leonard J. Spoehn <br /> <br />An 80 foot wide strip of land for fight-of-way <br />purposes, the centerline of said strip of land is as <br />follows: <br /> <br />Beginning at the intersection of the west line of the <br />east 10 rods of the Northwest Quarter of Section 35, <br />Township 32, Range 25, Anoka County, Minnesota, <br />and a line 390.00 feet northeasterly of as measured at <br />a right angle to and parallel with the northerly right- <br />of-way of the Burlington Northern Railroad; thence <br />northwesterly parallel with said northerly right-of- <br />way to the east line of Outlot A, RAMSEY 67 <br />INDUSTRIAL PARK FIRST ADDITION, Anoka <br />County, Minnesota and said centerline there <br />terminating.
