Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #91-12-269 <br /> <br />RESOLUTION FOR THE VACATION OF THE EASTERN 80 FEET OF THE <br />DRAINAGE EASEMENT LOCATED ON LOT 2, BLOCK 3, THE NORTH FORTY <br />3RD ADDITION (P.I.N. R20-32-25-12-0004) <br /> <br /> WHEREAS, certain drainage easements have been acquired by the City during the <br />platting of The North Forty 3rd Addition; and <br /> <br /> WHEREAS, certain portions of drainage easements are no longer necessary for use by <br />the City and public; and <br /> <br /> WHEREAS, the original need by the City for said easements may be fulfilled by the <br />retaining of a portion of the dedicated drainage easements; and <br /> <br /> WHEREAS, the developer of The North Forty 3rd Addition has requested that the City <br />vacate said drainage easements; and <br /> <br /> WHEREAS, M.S.A. 412.851 entitled Vacation of Streets permits the City Council to <br />vacate public grounds and public ways; and <br /> <br /> WHEREAS, on December 3, 1991, the Planning and Zoning Commission held a public <br />hearing on the issue of said easements in The North Forty 3rd Addition, which public hearing was <br />preceded by two weeks published notice in the Anoka County Union and posted notice and which <br />hearing all members of the public present were given the opportunity to be heard; and <br /> <br /> WHEREAS, after consideration of all relevant factors, City Council finds that it is in the <br />best interest of the public to vacate the said portion of the drainage easement. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the portion of the drainage easement legally described as follows is hereby vacated: <br /> <br />The south 140 feet of the north 150 feet of the east 80 feet of the west 150 feet of Lot 2, <br />Block 3, The North Forty 3rd Addition. <br /> <br />2) <br /> <br />That the City Administrator is hereby directed to prepare a Notice of Completion of the <br />Proceedings in conformance with M.S.A. 412.851. The City Administrator is then <br />directed to record the Notice of Completion with Anoka County to have said portion of <br />drainage easement removed from the title of said property. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Hardin and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gilbertson <br />Councilmember Peterson <br />Councilmember Hardin <br />Councilmember Cich <br />Councilmember Beyer <br /> <br /> <br />
