The city council finds it necessary for the promotion and <br />13 preservation of the health, safety, welfare, and aesthetics of the community that the con- <br />14 struction, location, size, conspicuity, brightness, legibility, operational characteristics, <br />15 and maintenance of off -premises digital billboard signs be controlled. Off -premises digi- <br />16 tal billboard signs have a direct and substantial impact on traffic safety, pedestrian <br />17 safety, community aesthetics and property values. If left uncontrolled, off -premises digi- <br />18 tal billboard signs, designed to catch the eye of persons in their vicinity and hold it for ex- <br />19 tended periods of time, including video display signs, constitute a serious traffic safety <br />20 threat. The city council intends by this subsection to establish a legal framework for off- <br />21 premises digital billboard sign regulation in the city to facilitate an easy and agreeable <br />22 communication between people while protecting and promoting the public health, safety, <br />23 welfare and aesthetics of the community. It is not the purpose or intent of this subsection <br />24 to prefer or favor commercial messages or speech over noncommercial messages or <br />25 speech or to discriminate between types of noncommercial speech or the viewpoints <br />26 represented therein. Rather, the purpose of the off -premises digital billboard sign regula- <br />27 tions promulgated in this subsection is: <br />28 a. To eliminate potential hazards to motorists and pedestrians using the public <br />29 streets, sidewalks, and rights -of -way; <br />30 b. To safeguard and enhance property values; <br />31 c. To control nuisances; <br />32 d. To preserve and improve the appearance of the city through adherence to aes- <br />33 thetic principles, in order to create a community that is attractive to residents and <br />34 to nonresidents who come to live, visit, work, or trade; <br />35 e. To eliminate excessive and confusing sign displays; <br />36 f. To encourage signs which by their design are integrated with and harmonious to <br />37 the surrounding environment and the buildings and sites they occupy; <br />38 g. To maintain the character of the main -street core downtown but allow local busi- <br />39 nesses the opportunity to reach a wider audience by advertising along Highway <br />40 10; and <br />41 h. To promote the public health, safety, and general welfare. <br />42 (2) Location of off -premises digital billboard signs. Notwithstanding anything to the contrary <br />43 contained within this Code, off -premises digital billboard signs may be located only <br />44 within the off -premises digital billboard sign overlay district. Off -premises digital billboard <br />45 signs are prohibited in all zoning districts of the city other than the off -premises digital <br />46 billboard sign overlay district.
