<br />use, or a conditional use. Therefore, the applicant has submitted an Interim Use Permit to <br />operate a daycare facility in the E-l Employment District. The daycare facility will serve a <br />maximum of 45-50 families. <br /> <br />Management Intern Gladhill indicated staff reviewed the site plan that was submitted as part of <br />the Interim Use Permit application. The existing building has 51 total parking spaces available. <br />Currently 21 spaces are reserved for employees. 8 of these reserved spaces are set aside for the <br />proposed daycare staff. The remaining 30 spaces will be available for the daycare clients. The <br />applicant has submitted a draft sketch plan stating how the applicant will adhere to State daycare <br />licensing for outdoor space. The proposed location is located in an industrial area, with moderate <br />to heavy commercial vehicle traffic. Garbage haulers, dump trucks, semis, and other various <br />commercial traffic frequent the area. The proposed location is within close proximity to <br />Commercial Asphalt, which does emit odors from asphalt production, as well as a high level of <br />commercial truck traffic during peak operating hours. <br /> <br />Staff expressed that the Planning Commission take into account levels of commercial traffic in <br />the area, proximity to various commercial activities, as well as outdoor space availability for a <br />play area on the proposed site. Any approval granted by the City is contingent upon compliance <br />with State and County daycare licensing requirements. While staff believes having a daycare in <br />an employment area would be a positive amenity for the community, staff believes this site is not <br />appropriate due to existing uses that surround the site. <br /> <br />Citizen Input <br /> <br />Mr. Derrick Bertolas, 6575 141st Avenue NW, stated they have been attempting to rent this <br />building Ol;Jt with permitted uses. They have tried working with real estate agents and mortgage <br />companies, and have gone one year without having. a tenant in there. Regarding the concerns <br />raised by staff, this daycare still has to go through a rigorous state licensing procedure, but they <br />cannot even proceed with licensing unless an Interim Use Permit is granted. <br /> <br />Commissioner Van Scoy asked how the children will have access to the proposed playground <br />and if they have to walk by the garbage disposal area to do so. <br /> <br />Mr. Bertolas replied they will have access one of two ways. If state licensing allows, there is an <br />existing door that would require the children to briefly go through the parking lot area. They are . <br />pretty sure they will have to insert a new door to the exterior play area, and this has been <br />included in the plans that have been drawn up. Use of the existing door would involve walking <br />by the dumpster. <br /> <br />Commissioner Trites Rolle asked if the individual that would run the daycare felt the issues <br />could be resolved and that the state would be amenable to this location, particularly considering <br />the issues listed such as an enclosed area, a location adjacent to traffic and a rail area, the area <br />free of litter, rubbish, etc. She asked if these issues are something Mr. Bertolas wants permission <br />to discuss with the State. <br /> <br />Planning Commission/October 5, 2006 <br />Page 6 of 20 <br /> <br />P6 <br />
